I didn't have this problem with M8, and as far as I can tell the project
is correctly configured (in the UI anyway) as requiring 1.4 compliance and
assert usage as Warnings - not Errors.

Any one else seeing this?

No, you need more than that.
Here is a screenshot that shows the right settings.
